Mountain Dew Contest
Enter the Mountain Dew Dewmocracy Contest. You have the chance to win the Grand Prize - cash prize of $50,000. Plus, the chance to win future net sales of 1% on the winning flavour of Mountain Dew. There are several methods to obtain entries for the Dewmocracy Contest.
1) Text ”Dew” to 80808 and follow the instructions to vote for your favourite MOUNTAIN DEW soft drink to get one entry. Limit one entry via this method per person per day.
2) Visit Dewmocracy.ca to register and vote for your favorite flavour to obtain one entry into the Grand Prize draw. Limit one (1) entry via this method per person per day.
3) Earn 5 entries by visiting Dewmocracy.ca to download a Facebook cover photo of your favourite Flavour.
4) Earn 10 entries by going to dewmocracy.ca and entering a unique PIN code. Pin codes are found on specially-marked packages MOUNTAIN DEW soft drink:
• 591 mL single serve bottles
• 12 x 355mL cans
You can request a pin code (without purchase) by telling them what you would do with $50,000 (minimum 150 words) and mailing it in.
To win the 1% future net sales, go to dewmocracy.ca and upload a video that cheers on your favourite Flavour. There is no limit to the number of Videos you may submit throughout the Contest Period.
Contest starts March 21, 2013.

The MOUNTAIN DEW DEWmocracy Contest (the “Contest”) is open only to natural persons who are legal residents of Canada and who are thirteen (13) years of age or older at the time of entry. You are not eligible to enter or to win if you are: (a) an employee, officer, director, representative or agent of PepsiCo Canada ULC, (the “Contest Sponsor”), its parent, subsidiary or related companies and, if applicable, their respective advertising or promotion agencies, or any other companies or individuals engaged in the provision of goods or services related to this Contest; (b) an employee, representative or agent of a competitor of the Contest Sponsor, its parent, subsidiary and affiliated companies; or (c) a member of the immediate family (parent, child, sibling, spouse, grandparent, grandchild, cousin, aunt or uncle, whether related through blood, marriage, common law, civil union or adoption, regardless of where they live) or household (whether related or not), of any of the above individuals. Contest void where prohibited.
If you are under the age of majority in your jurisdiction of residence, you must have your parent or legal guardian’s permission to enter the Contest.
A Facebook account and/or cell phone with text messaging functionality is required in order to participate in all aspects of the Contest. If you do not have Internet access via a personal computer, your local library or Internet café may be able to provide access to the Internet and a number of Internet service providers and other companies offer free email accounts. If an entrant is under the age of majority in the province or territory in which he/she resides, he/she must have the permission of his/her parent or legal guardian to enter the Contest. Entrant may be required to provide written proof of such permission upon request of the Contest Sponsor.
2. CONTEST PERIOD
The Contest begins at 8:00:00 AM Eastern Time (“ET”) on March 21, 2013 and ends at 11:59:59 PM ET on June 9, 2013 (the “Contest Period”).
3. HOW TO ENTER: NO PURCHASE NECESSARY
A. $50,000 CASH PRIZE: There are four (4) methods of entry into the $50,000 Cash Prize (as defined below), to a limit of one hundred and two (102) entries per person per day, regardless of method of entry, plus an additional five (5) entries per person per week for downloading a Facebook cover photo set out in (c) below. For the purposes of this Contest, “day” is defined as the calendar day beginning at 12:00:01 AM ET and ending at 11:59:59 PM ET (with the exception of the first day of the Contest, which begins at 8:00:00 AM ET). Duplication or any attempts to exceed the maximum number of registrations or accounts per person or per email address is a violation of these Official Contest Rules and may result in disqualification.
a. TEXT: To obtain one (1) entry into the Grand Prize Draw (as defined below), text ”Dew” to 80808 and follow the instructions to vote for your favourite MOUNTAIN DEW soft drink flavour currently being sold in promotional packaging at retail locations across Canada (each, a “Flavour”, and collectively, the “Flavours”). Your carrier’s standard text messaging rates may apply. Check with your mobile carrier for details specific to your service plan. You need not have tasted a Flavour to enter the Contest or win a Prize. Limit one (1) entry via this method per person per day.
b. VOTE FOR YOUR FLAVOUR: To obtain one (1) entry into the Grand Prize Draw (as defined below), visit Dewmocracy.ca (the “Contest Website”) and complete the required steps to register for the Contest including providing your name, age, phone number and email address. All fields are mandatory unless indicated as optional. Then, to obtain one (1) entry in the Contest, vote for your favourite Flavour. Limit one (1) entry via this method per person per day. You may register for only one (1) account and use only one (1) e-mail address in connection with this Contest.
c. DOWNLOAD FACEBOOK COVER PHOTO: To obtain five (5) entries into the Grand Prize Draw (as defined below), visit the Contest Website and download a Facebook cover photo of your favourite Flavour. If you have not already registered as described above, you will have to provide the above information prior to entering the Contest via this method. Limit one (1) entry via this method per person per week.
d. PIN ENTRY BY TEXT AND/OR PIN: To obtain ten (10) entries into the $50,000 Cash Prize (as defined below), visit the Contest Website and follow the instructions to enter a unique PIN code found either on specially-marked packages of MOUNTAIN DEW soft drink (591 mL single serve bottles and 12 x 355mL cans), while supplies last. Not all product and package sizes are available in all areas. You may also/instead text a unique PIN code to 80808 to obtain ten (10) entries into the $50,000 Cash Prize. To obtain a PIN without a purchase, tell us what you would do with $50,000 (minimum 150 words) and mail together with your name, age, phone number and email address to DEWmocracy Canada, 50 Charles Street East, PO Box 985, Toronto ON, M4Y 2N9, and one (1) PIN code will be emailed to you at the email address provided on entry. One (1) PIN code will be provided per entry received by the Contest Sponsor. Each mail-in PIN request must be sent in a separate outer envelope bearing sufficient postage, and must be the hand written original. Mail-in PIN requests that are mechanically produced or reproduced, whether printed, photocopied or otherwise, will not be accepted. The Contest Sponsor will use best efforts to email a PIN code to you in approximately two (2) business days following receipt of your envelope. Limit five (5) online PIN code entries and five (5) text PIN code entries per person per day (i.e. a total of one hundred (100) votes via ten (10) PIN code entries per person per day).
B. VIDEO ENTRY: To obtain one (1) entry for the Net Sales Prize (as defined below), visit the Contest Website and upload a video that advocates for your favourite Flavour (each, a “Video”, and collectively, the “Videos”). There is no limit to the number of Videos you may submit throughout the Contest Period.
Video must also comply with the following Submissions Guidelines:
(a) be an original work, created solely by the entrant registered on the Contest Website, and over which the entrant has all necessary rights, title and interest, including copyright (excluding any content provided by the Contest Sponsor);
(b) not infringe upon the intellectual property rights, or defame or invade the publicity or privacy rights, of any third party, living or deceased;
(c) not be confusingly similar to, or use, the brand names, trade names, trade-marks or logos of any third parties;
(d) be primarily in English and/or French;
(e) not contain or make any reference to any branded food or beverage products other than MOUNTAIN DEW soft drink;
(f) be submitted in one of the following video file formats: .AVI, .MOV, .MPEG4, .MPEGS, .WMV, .FLV, .3GPP, or .WEBM and be no more than 2 GB in size;
(g) not exceed sixty (60) seconds in length as submitted to the Contest Website;
(h) be suitable for family audiences and for display and publication on national television, in the sole determination of the Contest Sponsor. Without limitation, entries shall not contain any content that is or contains: the promotion of unlawful behaviour, profanity, nudity, explicit sexuality, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or is hatefully, racially, ethnically or otherwise offensive or objectionable;
(i) comply with the Statement of Rights & Responsibilities and other contracts and policies governing the FACEBOOK* platform (available at http://www.facebook.com/legal/terms);
(j) have been created specifically for this Contest, and have not been previously or currently published, or entered into, or received any awards in, any other contest or competition;
(k) be consistent with the Contest Sponsor’s corporate image; and
(l) otherwise comply with these Official Contest Rules.
The Contest Sponsor will review all entries for compliance with the above noted conditions and reserves the right at any time, in its sole and absolute discretion, to disqualify any entrant and to remove entries from the Contest Website that it finds or believes not to comply with the conditions above or otherwise with these Official Contest Rules. Videos that are determined in the Contest Sponsor’s sole discretion to be the subject of any scheme designed to compensate individuals for engaging in activities online that directly increases a Video’s Social Media Impact (as defined in the Criteria in section 4 (B) below) will be disqualified from the Contest and/or any associated prize will be forfeited. Videos may also be removed from the Contest Website and any associated prize forfeit in the event that the individual who submitted the Video has engaged, or is suspected of engaging in methods designed to affect their Video’s Social Media Impact—or that of any other Video—in violation of these Official Contest Rules, and to pursue all other applicable rights and remedies.
By submitting an entry, the entrant represents and warrants that: (a) he or she owns and controls all right, title and interest, including copyright, in and to all elements of the Video (excluding any content provided by the Contest Sponsor); (b) has the right and authority to, and does hereby, grant to the Contest Sponsor an irrevocable, non-exclusive, royalty-free worldwide license in perpetuity to reproduce, broadcast, communicate, distribute, adapt, modify and otherwise use all or any part of the entry submitted under this Contest on the Contest Website; and (c) waives all moral rights in and to the entry.
By entering the Contest, entrants agree to release and hold harmless the Contest Group (as defined below) from any and all claims that any commercial, advertising, presentation, web content or other material in any media throughout the universe subsequently produced, presented and/or prepared by or on behalf of the Contest Sponsor, infringes with regard to any elements, characters or ideas contained in the entry. For greater certainty, the Contest Sponsor will not be responsible should any future packaging, advertising, promotion, or other independently developed creative, marketing or advertising materials bear any resemblance to an entry that is not declared to be the winning entry.
Entries for both the Prizes must be received during the Contest Period. Proof of entry does not constitute proof of receipt. Entries will only be accepted through the Contest Website. No other means of transmission or delivery will be accepted. Late, garbled, incomplete or misdirected entries, or entries that do not comply with these Official Contest Rules, will be declared void and will be ineligible to win. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s). All entries shall be the sole property of the Contest Sponsor and will not be returned. All entries will be reviewed for compliance with these Official Contest Rules, though such review does not relieve entrants from responsibility for compliance with these Official Contest Rules. The Contest Sponsor reserves the right to review any entry at any time during the Contest for compliance with these Official Contest Rules and to take such action as it deems appropriate. In the event of a dispute regarding the identity of an entrant, the entry will be deemed to have been made by the authorized account holder of the email address submitted at the time of registration for the Contest. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses. Entrant acknowledges that the entry is not being submitted in confidence or in trust, and that no confidential or fiduciary relationship is intended or created. The potential winner may be required to show proof of being the authorized account holder.
4. THE PRIZES AND HOW TO WIN
A. $50,000 PRIZE AND DRAW:
There is one (1) cash prize available to be won, consisting of $50,000 CAD cash (the “Cash Prize”).
On July 8, 2013 at 2:00:00 PM ET, one (1) entry will be selected from among all eligible entries received during the Contest Period (the “Prize Draw”) as eligible to win the Grand Prize. The Prize Draw will take place at 2 Bloor St W, Suite 3200, Toronto, Ontario, M4W 3R6. Odds of winning the Grand Prize depend on the number of eligible entries received during the Contest Period. See prize conditions below.
Selected entrant will be notified on or about July 8, 2013 at the email address and/or phone number provided at the time of registration into the Contest, and must respond to Contest Sponsor or its agent within three (3) business days of such notification.
B. 1% OF NET SALES PRIZE AND JUDGING:
Each entry in the Contest will count as one (1) vote for a Flavour chosen by entrant. The Flavour to receive the greatest number of votes during the Contest Period will be selected as the winning Flavour (“Winning Flavour”). In the event that one or more Flavour has the same number of votes during the Contest Period, the tie will be broken by selecting the Flavour that had the most sales during the Contest Period, based on Sponsor’s data.
There is one (1) prize available to be won consisting of a cash prize in the amount of one percent (1%) of future net sales of the Winning Flavour (the “Future Canadian Net Sales”) as sold under the Winning Flavour name in Canada for up to a maximum of two (2) consecutive years from July 15th, 2013 (the “Net Sales Prize”). Approximate estimated value of the Net Sales Prize is one hundred and thirty four thousand dollars ($134,000 CAD), to be paid out over the course of two (2) consecutive calendar years. Actual Net Sales Prize value may differ, and Sponsor cannot guarantee the value of the Future Canadian Net Sales.
Following the Contest Period, an independent panel of judges will judge all eligible Videos received during the Contest Period that advocate for the Winning Flavour. Each Video will be given a score out of one hundred (100) in accordance with the following criteria (collectively, the “Criteria”):
Originality & Creativity (34%)
Passion for Mountain Dew Flavour (33%)
Social Media Impact (unique video views and Likes via Contest Website) (33%)
The entrant whose Video receives the highest score based on the Criteria will be eligible to win the Net Sales Prize. Odds of winning the Net Sales Prize depend upon the judged score your Video receives and which Flavour receives the highest number of votes during the Contest Period.
Selected entrant will be notified by July 15, 2013 at the email address provided at the time of registration into the Contest, and must respond to Contest Sponsor or its agent within three (3) business days of such notification.
